Following his label mate Lil Wayne, rapper Drake has been hit with a copyright infringement lawsuit. Drake is reportedly being sued by Playboy Enterprises for his “Best I Ever Had” hit, claiming that the track illegally samples another song. Playboy claims that Drake, Cash Money Records and Universal Records allegedly sampled their song “Fallin’ In Love,” by Hamilton, Joe Frank, and Dennison/Reynolds in the beginning of Drake’s track. Playboy wants the court to issue an injunction to stop the selling/distributing of the song. According to Playboy Enterprises, Drake had prior knowledge of the sample. “[They] knew or should have reasonably known, that the sound recording was protected by copyright…” and that “each Defendant continues to infringe upon Plaintiff’s rights in and to the copyrighted sound recording.” Take a listen to Fallin In Love below. What do you think; does the song sound similar?
